Complaint Process

 

Concerns or complaints should be addressed in the following order:

  1. Teacher, Coach, Specialist, or Non-Administrative Staff Member
    Contact the individual directly involved with the concern.

  2. School Principal or Counselor
    If the issue is not resolved, escalate to the building-level administrator.

  3. Central Office Administrator
    If further resolution is needed, contact the appropriate district-level administrator.

  4. Superintendent
    If all other avenues have been pursued without resolution, contact the Superintendent’s Office.

At every step, students, faculty, and staff members who are the subject of a complaint will be afforded full due process rights.


Formal Grievance Procedures for Complaints & Discrimination

Students, as well as their parents/guardians, who believe they have a discrimination grievance (civil rights, disability, or sexual harassment) must first report the behavior or condition believed to be discriminatory to any school staff member with whom they have confidence.

  • Any staff member receiving such a complaint must immediately report the behavior/conditions to his/her immediate supervisor and/or the Title IX or ADA/504 Coordinator.

  • A conference will be held with the complainant and appropriate school personnel to arrive at a mutually satisfactory resolution of the complaint or grievance.

  • If the complaint is not resolved, it may be escalated following the Attalla City Schools Complaint Process outlined above.

SUPPORTIVE MEASURES

Offered immediately to complainants and respondents, with or without a formal complaint.

Examples:

  • Schedule changes

  • No-contact directives

  • Counseling referrals

  • Academic adjustments

  • Safety planning

  • Extensions on assignments or deadlines


FORMAL TITLE IX PROCESS

If a formal complaint is filed, the district will:

  1. Notify both parties of the allegations

  2. Assign trained, impartial personnel

  3. Investigate by gathering facts and interviewing witnesses

  4. Share all relevant evidence with both parties

  5. Allow written responses

  6. Maintain fairness, privacy, and due process


ROLE SEPARATION

To ensure fairness, the following positions are independent:

  • Title IX Coordinator

  • Investigator

  • Decision-Maker

  • Appeal Officer

No individual may serve in more than one role for the same case.


DETERMINATION & APPEALS

After reviewing evidence, the Decision-Maker issues a written determination.
Either party may appeal based on:

  • Procedural errors

  • New evidence

  • Conflict of interest or bias


INFORMAL RESOLUTION

Optional, voluntary, and available only if both parties agree.
(Not available when a student reports an employee.)


RETALIATION PROHIBITED

No one may be punished, threatened, or mistreated for reporting or participating in a Title IX process.
False reports made in bad faith may result in consequences.


PREGNANT & PARENTING STUDENTS

Students who are pregnant or parenting have the right to:

  • Stay in school

  • Receive reasonable adjustments

  • Make up missed work

  • Access all programs and activities

  • Learn free from discrimination


RECORDKEEPING

In compliance with federal law, Attalla City Schools keeps all Title IX documentation — including reports, investigations, decisions, supportive measures, and training materials — for 7 years.


TRAINING MATERIALS

Training materials for the Title IX Coordinator, Investigators, Decision-Makers, and Appeal Officers are available upon request and posted publicly on the district’s Title IX page. Erin's Law, Savannah Hardin Act & Mandatory Reporting yearly trainings are required for all staff.
